These Terms of Service ("Terms") govern your access to and use of aivolearn.com and the products and courses offered by Aivolearn, operated by Aivolearn("we," "us," or "our"). By using our site or purchasing our products, you are contracting with Aivolearn and you agree to these Terms. If you do not agree, please stop using the service.
1. Who we are
Aivolearn provides online educational content, courses and an AI tutor. We are based in Boston, Massachusetts, United States. Contact: support@aivolearn.com. You confirm that you are of legal age to enter this agreement, and that where you are signing up on behalf of an organisation you have authority to bind it.
2. Payments and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle handles payment processing, billing, taxes, renewals and cancellations, and their buyer terms also apply to your purchase: paddle.com/legal/checkout-buyer-terms
Our certification programme is sold as a recurring monthly subscription which renews automatically until cancelled. You can cancel at any time through your account or through Paddle.
3. Accounts
To access certain products you may need to create an account. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information when registering and keep it up to date.
4. License and use of content
When you subscribe, we grant you a limited, personal, non-transferable, non-exclusive license to access and use the content for your own learning while your subscription is active. You may not:
- Share, resell, redistribute, or publicly post the content
- Copy or reproduce the materials except as needed for your personal use
- Reverse engineer the service or circumvent technical limits
- Use the content to create a competing product
All content, including lessons, exam material, certificates, text, branding and software, remains our intellectual property.
5. Acceptable use
You agree not to misuse the site. In particular, you must not use it unlawfully, engage in fraud or spam, infringe anyone's intellectual property, or interfere with security (including malware, probing, or scraping).
6. AI tutor and generated content
Our AI tutor generates responses automatically. You are responsible for your prompts, for how you use outputs, for verifying accuracy, and for having the rights to any content you submit. You must not use the tutor to produce illegal content, hate speech, deepfakes or malware, or to attempt to jailbreak the model. Outputs may be inaccurate or incomplete and are not a substitute for professional, legal, financial or medical advice. We may filter, refuse, remove or restrict content and suspend accounts for misuse. If you believe content infringes your rights, contact us at support@aivolearn.com and we will review it; repeat infringement leads to termination.
7. Service level and disclaimers
Our courses are provided for educational purposes. We do not guarantee any specific outcome, result, or income from using our content, and we do not guarantee that the service will be uninterrupted or error-free. To the fullest extent permitted by law, the products are provided "as is" without warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, including loss of profits, data or goodwill. Our total aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing in these Terms limits liability for fraud, death or personal injury, or any liability that cannot be limited under applicable law.
9. Refunds
Our refund policy is described in our Refund Policy. Refund requests are handled by Paddle as our Merchant of Record.
10. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time. When access ends, your subscription content is no longer available; you can request an export of your account data by contacting us before deletion.
11. Changes to the service and Terms
We may update our products, site, or these Terms at any time. Continued use after changes take effect constitutes acceptance of the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles, and the courts of that jurisdiction have exclusive jurisdiction over any dispute. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
